NEW LAW – TENANT APPLICATION FRAUD IS NOW A FELONY

Florida has enacted a major new law that directly impacts rental housing providers: fraudulent rental applications — fake pay stubs, forged or altered IDs, stolen identities, false income claims — are now a third-degree felony. Just as important, "fraudulent entry" is now clearly a non-curable violation, so you may serve a 7-day notice to vacate with no opportunity to cure. The law takes effect October 1, 2026. Now is the time to tighten screening and update your lease language.

LEGAL HOLIDAY ALERT – DON'T FORGET JULY 3

Often a legal holiday falls on a weekend, or it's simply not a big holiday to you. Well, banks and public workers get a good deal — and they are often closed. When a holiday falls on a Saturday or Sunday, be aware of when that court holiday is "observed" and get those Three Day Notices done correctly. Counties and municipalities are rapidly jumping on the rental registration bandwagon throughout Florida. Fees range from $20.00 to $200.00 for a registration. Now is the time to carefully watch your local city council and county's actions, and if they are proposing a fee program, you need to mobilize and work with the city or county to prevent them from creating an ordinance that may not work for you. Sitting back and doing nothing will result in very unexpected and unpleasant results. Check now to see if you are in compliance, as ordinances are often enacted with little notice.

Just about everyone knows that the Notice of Intention to Impose Claim on Security Deposit must be sent out by certified mail, or by email if the tenant has previously agreed to that in writing.
